ខ្លឹមសារ នៃលទ្ធផល កិច្ចចរចា ស្តីពី ការតាក់តែង ច្បាប់បោះឆ្នោតថ្មី
កាលពីថ្ងៃសៅរ៍ ២៨ កុម្ភៈ ២០១៥ នៅមន្ទីរ រដ្ឋសភា, ថ្នាក់ដឹកនាំ គណបក្ស ប្រជាជនកម្ពុជា និងថ្នាក់ដឹកនាំ គណបក្ស សង្រេ្គាះជាតិ បានជួបប្រជុំ ពិភាក្សាគ្នា ដើម្បី ដោះស្រាយ ចំណុចសេសសល់ ដែលក្រុមការងារ គណបក្ស ទាំងពីរ មិនទាន់បាន ឯកភាពគ្នា លើសេចក្តីព្រាង សេចក្តីស្នើ វិសោធនកម្ម ច្បាប់ ស្តីពី ការបោះឆ្នោត ជ្រើសតាំង តំណាងរាស្ត្រ។
ថ្នាក់ដឹកនាំ នៃគណបក្ស ទាំងពីរ បានដោះស្រាយ បញ្ចប់ នូវរាល់បញ្ហា ដែលនៅសេសសល់ ទាំងអស់ នៃសេចក្តីព្រាង វិសោធនកម្ម ច្បាប់ ដូចមាន ចែងខាងលើ។
កិច្ចព្រមព្រៀង ខាងលើនេះ មានខ្លឹមសារ និងអត្ថន័យ ដូចតទៅ៖
១. ជាជំហាន នយោបាយ ចុងក្រោយ ឆ្ពោះទៅ ការអនុម័ត ដោយរដ្ឋសភា នូវច្បាប់ បោះឆ្នោត ថ្មីមួយ សម្រាប់ រៀបចំ ការបោះឆ្នោត ឃុំ-សង្កាត់ ឆ្នាំ ២០១៧ និងការបោះឆ្នោត ជាតិ ឆ្នាំ២០១៨។
២. ជាដំណាក់កាល ចុងក្រោយ ផងដែរ ដើម្បី បើកផ្លូវ ឲ្យរដ្ឋសភា អនុម័តច្បាប់ មួយទៀត ទាក់ទងទៅ នឹងការ បោះឆ្នោតដែរ, គឺ ច្បាប់ ស្តីពី ការរៀបចំ និងការប្រព្រឹត្តិទៅ នៃគណៈកម្មាធិការ ជាតិ រៀបចំ ការបោះឆ្នោត (គ.ជ.ប.) ដែលអត្ថបទ នៃសេចក្តីព្រាង ទទួលបាន ការឯកភាព ទាំងស្រុងហើយ ពីគណបក្ស ទាំងពីរ ដែលមាន អសនៈ ក្នុងរដ្ឋសភា។
៣. បន្ទាប់ ពីរដ្ឋសភា បានអនុម័ត ច្បាប់ ទាំងពីរ ខាងលើ នេះហើយ, គណៈកម្មាធិការ អចិន្ត្រៃយ៍ នៃរដ្ឋសភា នឹងចាប់ផ្តើម ជ្រើសរើស សមាសភាព ថ្មី នៃគណៈកម្មាធិការ ជាតិ រៀបចំ ការបោះឆ្នោត (គ.ជ.ប.) ដែលជាការ អនុវត្តន៍ តាមមាត្រា ថ្មីមួយ ស្តីពី គ.ជ.ប. ដែលទើបតែ ដាក់បញ្ចូល ក្នុងរដ្ឋធម្មនុញ្ញ កាលពីថ្ងៃ ទី១ ខែតុលា ឆ្នាំ ២០១៤ (បន្ទាប់ ពីគណបក្ស ទាំងពីរ បានចុះ កិច្ចព្រមព្រៀង បញ្ចប់វិបត្តិ នយោបាយ នៅថ្ងៃ ទី២២ ខែកក្កដា ឆ្នាំ២០១៤)។ សូម រំលឹកថា, គ.ជ.ប. ថ្មីនេះ នឹងមាន សមាជិក ប្រាំបួនរូប--គឺ, បួនរូប មកពីគណបក្ស ប្រជាជនកម្ពុជា; បួនរូបទៀត មកពីគណបក្ស សង្រេ្គាះជាតិ; និងមួយរូប ចុងក្រោយ មកពីសង្គមស៊ីវិល, ហើយ គ្មាន ចំណុះនយោបាយ។
៤. ក្នុងច្បាប់ បោះឆ្នោត ថ្មី, គណបក្ស ទាំងពីរ ដែលជាអ្នក រៀបចំ តាក់តែង ធានា ឲ្យមាន ការគោរព គោលការណ៍ ប្រជាធិបតេយ្យ ជាមូលដ្ឋាន មានជាអាទិ៍៖
- សុក្រិតភាព និងតម្លាភាព ក្នុងការរៀបចំ ការបោះឆ្នោត ដើម្បី ធានា គោរពឆន្ទៈ ប្រជារាស្ត្រ;
- សិទ្ធិសម្តែងមតិ របស់ ប្រជាពលរដ្ឋ គ្រប់រូប និងរបស់ សង្គមស៊ីវិល;
- ហាមឃាត់ មិន ឲ្យមាន ការគំរាមកំហែង;
- ហាមឃាត់ មិន ឲ្យមាន ការទិញដូរ សន្លឹកឆ្នោត;
- សមធម៌ ក្នុងយុទ្ធនាការ ឃោសនា បោះឆ្នោត។
លទ្ធផល នៃការចរចា ខាងលើនេះ គឺ បានមក ពីការធ្វើ សម្បទាន ឲ្យគ្នា ទៅវិញទៅមក រវាង គណបក្ស ធំៗ ទាំងពីរ ដែលកំពុង តែ សម្រេច វាសនា ប្រទេសជាតិ។ លទ្ធផលនេះ ក៏ជាផ្លែផ្កា ដ៏ប្រសើរ នៃវប្បធម៌សន្ទនា ដែលគណបក្ស ទាំងពីរ បានចាប់យក ទន្ទឹមគ្នា ដើម្បី ដោះស្រាយ រាល់បញ្ហា ដោយសន្តិវិធី ក្នុងគោលដៅ បម្រើ និងការពារ ឧត្តមប្រយោជន៍ ប្រទេសជាតិ៕

RESULTS OF LATEST TALKS ON NEW ELECTION LAW
On Saturday 28 February 2015, at the National Assembly, the leaderships of the CPP and the CNRP met in order to discuss the remaining points of disagreement that the working groups of the two parties had not yet resolved with regard to the draft of amendments to the Law on the Election of Members of the National Assembly (LEMNA).
The leaderships of the two parties finally resolved all those remaining points of disagreement.
Here are the substance and the meaning of the final agreement:
1. The agreement is the final political step before the adoption by the National Assembly of the amended LEMNA that will govern the 2017 commune election and the 2018 national election.
2. The agreement is also the final step before the adoption by the National Assembly of another election-related law, i.e. the Law governing the formation and the functioning of the National Election Committee (NEC) whose draft has been entirely approved by the two parties having seats at the National Assembly.
3. After the adoption of the two above-mentioned laws, the Standing Committee of the National Assembly will start selecting the nine members of the new NEC as a measure to implement the new provision on the NEC introduced in the Constitution on 1st October 2014 (following the 22 July 2014 crisis-solving agreement between the CPP and the CNRP). According to this provision, the new NEC will have four members from the CPP, four members from the CNRP and one neutral member from the civil society.
4. In the new LEMNA, the two parties working together guarantee the respect of fundamental democratic principles, such as
- Integrity and transparency of the election process so as to ensure the respect of the people’s will
- Freedom of expression for all citizens and for the civil society
- Prohibition of political threats
- Prohibition of vote-buying
- Equity for all parties in the election campaign.
The above negotiation results were achieved through mutual concessions made by the two parties that are determining the fate of the nation. They are also attributable to the culture of dialogue that the two parties have simultaneously embraced in order to settle peacefully all problems with the purpose of serving and defending the nation’s interests.
