Constitution Article 87: In the case the president or vice-president of the National Assembly resigns from his/her post or dies, the National Assembly shall vote to elect a new president or vice-president.

មាត្រា ៨៧ រដ្ឋធម្មនុញ្ញ ចែងថា, ប្រធាន និងអនុប្រធាន សភា អាចបាត់តំណែង បាន លុះត្រា មរណ:ភាព ឬលាលែងចេញ ពីតំណែង ដោយខ្លួនឯង, ហើយ គ្មាន និត្តិវិធីណា បោះឆ្នោត ទំលាក់ ប្រធាន និងអនុប្រធាន សភាទេ។

ដូចនេះ ការដកតំណែង លោកអនុប្រធាន ទី១ នៃរដ្ឋសភា កឹម សុខា ដោយការ បោះឆ្នោត ក្រោមសម្លេង បក្សប្រជាជន ៦៨ លើ៦៨ គឺ ជាការរំលោភ តាមច្បាប់ រដ្ឋធម្មនុញ្ញា នៃព្រះរាជាណាចក្រកម្ពុជា ទាំងស្រុង។
